Terms of Service

1. About us

ONX is operated by Optimal Nexus Ltd, a company registered in England and Wales (Company No. pending registration). Our registered office is in the United Kingdom. By using the ONX platform ("Service"), you agree to these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. The Service

ONX is a B2B GTM intelligence platform that helps revenue teams identify, research, and prioritise companies that match their ideal customer profile. The Service includes company discovery, contact enrichment, signal scoring, and market sizing tools.

We process publicly available business information and third-party enrichment data. All contact data processed through the Service is intended for legitimate B2B prospecting purposes under the lawful basis of legitimate interests, in accordance with UK GDPR and EU GDPR.

3. Your account

  • You must provide accurate information when registering and keep it up to date.
  • You are responsible for maintaining the security of your credentials.
  • You may not share your account or use the Service on behalf of a third party without a separate agreement.
  • You must be at least 18 years old and authorised to enter into legally binding contracts.

4. Acceptable use

You agree not to:

  • Use the Service for consumer marketing, spam, or any purpose that violates applicable law.
  • Reverse engineer, scrape, or extract data from the Service in bulk by automated means.
  • Use contact data discovered through the Service in a manner that violates GDPR, the UK GDPR, or PECR.
  • Resell, sublicense, or transfer access to the Service to third parties.
  • Attempt to circumvent rate limits, access controls, or security measures.

5. Subscription and billing

Subscriptions are billed monthly or annually in advance via Stripe. Prices are stated in GBP and exclusive of VAT unless stated otherwise. We reserve the right to change pricing with 30 days' notice to existing subscribers.

You may cancel at any time via your account settings. Cancellation takes effect at the end of the current billing period — no partial refunds are issued unless required by law.

6. Data and privacy

Our handling of personal data is described in our Privacy Policy. By using the Service you acknowledge that you have read and understood it.

You are the data controller for any personal data you process using the Service. Optimal Nexus Ltd acts as a data processor on your behalf. A Data Processing Agreement (DPA) is available on request at compliance@optimalnexus.com.

7. Intellectual property

All rights in the Service, including software, design, and branding, remain with Optimal Nexus Ltd. You retain ownership of data you upload to the Service. We do not claim ownership of your data.

8. Limitation of liability

To the maximum extent permitted by law, Optimal Nexus Ltd's total liability to you in any 12-month period is limited to the fees you paid during that period. We are not liable for indirect, consequential, or punitive damages.

The Service is provided "as is." We do not warrant that enrichment data is accurate, complete, or up to date. You should verify contact information before use.

9. Termination

We may suspend or terminate your account if you breach these Terms, after giving notice where practicable. You may request deletion of your account and data at any time — see our Privacy Policy for details.

10. Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
